The EVunited mobile application is powered by ChargeLab’s platform and operates as part of the ChargeLab system. While the app is branded for EVunited, it leverages ChargeLab’s backend technology, user accounts, and data infrastructure. As such, the collection, use, and protection of personal information for EVunited app users are governed by ChargeLab’s Privacy Policy outlined below.

ChargeLab Inc. (“ChargeLab”, “we”, or “us”) values and respects your privacy. We have prepared this privacy policy to explain the manner in which we collect, use and disclose personal information when you visit our website located at https://www.chargelab.co/ (the “Website”), download or use our mobile app available at https://www.chargelab.co/app (the “App”), or otherwise interact with us.

ChargeLab provides an operating system for EV chargers. We're the back-end software powering North America's leading EV charging networks and charging services provided by a range of organizations. We enable EV drivers to charge their vehicles using charging stations or equipment provided by us or third parties that resell our services or own, operate or otherwise control a particular EV charging equipment at a particular location.

COLLECTION AND USE OF PERSONAL INFORMATION 

We may collect personal information when you:

    • Create a ChargeLab account 
    • Download, install or use the ChargeLab app
    • Pay for your charging session
    • Charge your vehicle
    • Sign-up to receive marketing emails such as newsletters, offers and promotions
    • Enter a contest or participate in a promotion or beta products
    • Engage with ChargeLab through social media
    • Apply for a job at ChargeLab
    • Participate in our surveys
    • Contact us for customer support or with a comment, question or complaint

ChargeLab Account: ChargeLab offers a single sign-on experience. In order to use an EV charging station offered by ChargeLab or one of our site host or reseller partners, you are required to create a ChargeLab account. To create your account, we collect your first and last name, email address and phone number and may also collect a password that you create. When you create an account on a partner’s app, you will automatically also create an account that can be used on the ChargeLab app (and vice versa). When you log in to any new partner applications, your account with the new partner will be created using the same user ID and linked to your ChargeLab account. See “How we Share Personal Information” below to learn how we share data with our partners.

Payment Processing: We collect personal information in order to process your payment for EV charging on the ChargeLab app. To process your payment, we require your first and last time, billing address and payment card information (payment card information including credit card number, expiry date and CVV/CVC code is processed by our third party payment processor). You are required to have a payment card on file in order to start a charging station. You can change or update your payment method at any time. To delete your payment method, please delete your account. We may also process payments on behalf of certain of our site hosts or reseller partners.

Charging Your Vehicle: In order to charge your electric vehicle, you may be required to authenticate yourself using a valid authentication method such as an RFID access card.  If you use our Plug&Charge service, we may also collect your vehicle certificate in order to recognize your vehicle and account. When you charge your vehicle using your ChargeLab account at a ChargeLab or partner EV charging station, we collect information about your charging session including timestamp, duration of charge, charger location and we  make this data available to you through your ChargeLab account. We use charging data to track usage and improve charger reliability. You can view your charging data and payment history for all charging sessions made under your ChargeLab account (either directly with ChargeLab or with one of our partner site hosts or resellers) by logging into the ChargeLab app. You can also view your charging data and payment history with a particular site host or reseller by logging into their app. 

Marketing Communications: If you sign up to receive our email marketing communications, we will collect your mobile number or email address in order to send you newsletters, offers, promotions, and the latest updates that may be tailored to your interests and preferences. You can unsubscribe at any time by clicking the “unsubscribe” link included at the bottom of each email. Alternatively, you can opt-out of receiving marketing communications by contacting us at the contact information provided in the “Contact Us” section below. Please note that you may continue to receive transactional or account-related communications from us. 

If you sign-up to receive our email marketing communications, we may use services provided by third-party platforms (such as social media and other websites) to serve tailored advertisements on such platforms to you or others, and we may provide a hashed version of your email address or other information to the platform provider for such purposes. To opt-out of the sharing of your information for these purposes, please send a request to marketing@chargelab.co.  

Contests and Promotions: When you enter a contest or participate in a promotion, we may collect your name, address, email address, phone number, and any additional information or content required for the contest or promotion, including to deliver a prize to you. We use this information to administer your participation in the contest or promotion. 

Employment: In connection with a job application or related inquiry, you may provide us with certain personal information about yourself (such as that contained in a resume, cover letter, or similar employment-related materials). We use this information for the purpose of processing and responding to your application for current and future career opportunities.

Surveys: From time to time, we may offer you the opportunity to participate in one of our surveys. The information obtained through our surveys is used in an aggregated, de-identified form. We use this information to help us understand our users, enhance our Website and improve our products and services.

Contact Us: When you contact us with a comment, question or complaint, you may be asked for information that identifies you, such as your name, address and a telephone number, along with additional information we need to help us promptly answer your question or respond to your comment.  We may retain this information to assist you in the future and to improve our customer service and products. We may record telephone calls to our customer service line for quality assurance and training purposes. If you don’t wish for your call to be recorded, please let us know. 

HOW WE COLLECT PERSONAL INFORMATION

We collect personal information you collect from us directly, as well as information collected through automated means as described under “Website Information” and “Mobile App Data”. 

WEBSITE INFORMATION 

Visiting our Website:  In general, you can visit our Website without telling us who you are or submitting any personal information. However, we collect the IP (Internet protocol) addresses of all visitors to our Website and other related information such as page requests, browser type, operating system and average time spent on our Website. We use this information to help us understand our Website activity and to monitor and improve our Website.

Cookies:  When you visit our Sites, we may obtain certain information by automated means, such as through cookies, web beacons, pixels and other technologies. A “cookie” is a text file that websites send to a visitor’s computer or other internet-connected device to uniquely identify the visitor’s browser or to store information or settings in the browser. A “web beacon,” also known as an internet tag, pixel tag or clear GIF, links web pages to web servers and cookies and may be used to transmit information collected through cookies back to a web server. You may set your browser to notify you when you receive a cookie or to not accept certain cookies. However, if you decide not to accept cookies from our Website, you may not be able to take advantage of all of the Website features. We use these technologies to operate the Website, such as to enable you to log into secure areas. We also use these technologies to recognize when you return to the Website and to personalize our content for you, greet you by name, remember your preferences (for example, your choice of language or region) and to integrate useful services provided by third party providers into our Website e.g. social media features. We also use these technologies for analytics and interest-based advertising as described below. Analytics: We may use a third-party such as Google Analytics to help us gather and analyze information about the areas visited on the Website (such as the pages most read, time spent, search terms and other engagement data) in order to evaluate and improve the user experience and the Website. These third parties may use cookies and other tracking technologies. Third-Party Links:  Our Website may contain links to other websites that ChargeLab does not own or operate. We provide links to third-party websites as a convenience to the user. These links are not intended as an endorsement of or referral to the linked websites. The linked websites have separate and independent privacy policies, notices and terms of use. We do not have any control over such websites, and therefore we have no responsibility or liability for the manner in which the organizations that operate such linked websites may collect, use or disclose, secure and otherwise treat personal information. We encourage you to read the privacy policy of every website you visit.

MOBILE APP DATA

Location Information: With your consent, we may collect your location information by accessing your device’s GPS coordinates so that we can provide you with location-based services, such as locating the nearest charging station. You can opt-out at any time by turning off your location services for the App in the settings of your mobile device.

Push Notifications: If you sign-up to receive push notifications, we will send push notifications to your mobile device. If you wish to stop receiving push notifications from us, you can turn off push notifications for the App either within the settings page of the App, or in the settings of your mobile device.

Camera: We also require access to the camera on your mobile device so that you can scan a QR code on the charging unit in order to start a charging session. You can revoke this permission by changing the Settings for the ChargeLab app on your device. 

App Usage Information & Analytics: As with many applications, certain limited data is required for the App to function on your device. This data includes the type of device hardware and operating system, unique device identifier, IP address, language settings, and the date and time the App accesses our servers. We use this information to help us understand the activity on our App, to monitor and improve our App, and to tailor your in-App experience. In addition, we may use third party service providers to collect analytical information about your use of the App, such as the App features used and time spent on the App, to help us tailor your in-app experience, improve our products and the quality of our App, and to manage and analyze data in order to better understand our users. You can manage how your device and browser share certain device data by adjusting the privacy and security settings on your mobile device. 

INTEREST-BASED ADVERTISING

We work with third parties such as ad networks and other advertising companies that use their own tracking technologies (including cookies, web beacons and pixel tags) on our Website in order to provide you with tailored advertisements across the Internet. This is a common marketing practice referred to as interest-based or online behavioural advertising. These companies may collect information about your activity on our Website and third-party websites (such as web pages you visit and your interaction with our advertising and other communications) and use this information to make predictions about your preferences, develop personalized content and deliver ads that are more relevant to you on third-party websites. This information may also be used to evaluate the effectiveness of our online advertising campaigns.

  • Please note that even if you opt-out of interest-based advertising by a third-party, these tracking technologies may still collect data for other purposes including analytics and you will still see ads from us, but the ads will not be targeted based on behavioural information about you and may therefore be less relevant to you and your interests. 
  • To successfully opt out, you must have cookies enabled in your web browser (see your browser’s instructions for information on cookies and how to enable them). Your opt-out only applies to the web browser you use so you must opt-out of each web browser on each computer you use. Once you opt out, if you delete your browser’s saved cookies, you will need to opt-out again.

SHARING OF PERSONAL INFORMATION

We do not sell or disclose your personal information to third parties without your consent, except as set forth below or as required or permitted by law.

Site Hosts/Resellers: When you charge at a partner charging station, we share certain personal information (including information about your charging session) with the applicable reseller for the purposes of providing customer support, troubleshooting issues related to the charging station, and to validate payment remittances from ChargeLab. The partner will collect, use, disclose and otherwise handle your personal information in accordance with their own practices or privacy policies which we recommend that you obtain and review carefully.

Service Providers: Your personal information will be transferred (or otherwise made available) to certain third parties that provide services on our behalf. We use service providers to provide services such as hosting the Website, sending communications on our behalf, processing payments, providing advertising, marketing and analytics service.. Our service providers are only provided with the information they need to perform their designated functions and are not authorized to use or disclose personal information for their own marketing or other purposes. Our service providers may access or store personal information in the U.S., Canada or other foreign jurisdictions.

Plug and Charge Providers: If you enroll in the our Plug&Charge program to authenticate your vehicle with ChargeLab in order to charge your vehicle without using the ChargeLab app, you will be required to install a certificate in your vehicle from your vehicle manufacturer. We will collect this key from your vehicle so that we can recognize you when you are at a ChargeLab charging session. We also collect and share certain information with our Plug&Charge partners, including your name, contact information, VIN/Unique Vehicle identifier, charging session details (start and end time, meter location and readings) and payment information (only if applicable).  

Electricity Providers: If you have signed up for a rebate program with your local electricity provider and provided consent, we may share driver account and usage information with your electricity provider to verify redemption of the utility rebate.   

Carbon Credits: We may also generate aggregated and anonymized statistical data and share that data in order to purchase carbon credits. 

Legal and Compliance: We and our Canadian, US and other foreign service providers may provide your personal information in response to a search warrant to other legally valid inquiry or order, or to another organization for the purposes of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise may be required or permitted by applicable Canadian, U.S. or other law or legal process, which may include lawful access by US or foreign courts, law enforcement or other government authorities. Your personal information may also be disclosed where necessary for the establishment, exercise or defence of legal claims and to investigate or prevent actual or suspected loss or harm to persons or property.

Sale of Business: We may transfer any information we have about you as an asset in connection with a proposed or completed merger, acquisition or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of ChargeLab or as part of a corporate reorganization or other change in corporate control.

SAFEGUARDS AND RETENTION

We have implemented reasonable administrative, technical and physical measures in an effort to safeguard the personal information in our custody and control against theft, loss and unauthorized access, use, modification and disclosure. We restrict access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements.

We have record retention processes designed to retain personal information for no longer than necessary for the purposes set out herein or as otherwise required to meet legal or business requirements.

TRANSFERS ACROSS BORDERS

Your personal information may be stored outside of the country, province or region where you reside, including in Canada and the United States. Your personal information will be subject to the laws of the jurisdictions in which it is stored, including laws that may permit access by law enforcement, courts or government authorities in those jurisdictions. YOUR CHOICES

You can withdraw your consent to our collection, use and disclosure of personal information at any time by providing us with reasonable notice, subject to legal or contractual restrictions. Please note that if you withdraw your consent, we will not be able to continue to provide services to you. We may retain your personal information where required to meet our legal and contractual obligations.

YOUR RIGHTS

Subject to limited exceptions under applicable law, you have the right to access, update and correct inaccuracies in your personal information in our custody or control. You may request access, updating and corrections of inaccuracies in your personal information in our custody or control by emailing or writing to us at the contact information set out below. We may request certain personal information for the purpose of verifying the identity of the individual seeking access to his or her personal information records. 

You can also view certain of your personal information including your charging data and payment history for all charging sessions made under your ChargeLab account by logging into the ChargeLab app. You may delete this information through our application. 

UPDATES TO THE PRIVACY POLICY

We may update this privacy policy periodically to reflect changes to our privacy practices. We encourage you to periodically review this page to ensure you are familiar with those changes. We will indicate at the top of this privacy policy when it was most recently updated.
